  10. Page 7: SC allows abortion of ailing foetus Upholding her right to choose, the Supreme Court allowed a woman to abort her over 20- week-old foetus with severe abnormalities. A Bench of dictating the order in an open court, took note of the mental stress suffered by Sharmishta Chakraborty. The law does not permit abortion if the foetus is over 20 weeks old. The Supreme Court's decision whether a woman should be allowed to abort or not after the 20 weeks period has been on a case- to-case basis. The primary factor that has guided its decisions has been the expert opinion of a court-appointed medical board on the risk it poses to the mother and the child. Medical Termination of Pregnancy Act of 1971 bars abortion if the foetus has crossed the 20-week mark. An exception to the law is made if a registered medical practitioner certifies to a court that the continued pregnancy is life-threatening for the mother or the baby. The indication from the court may spell future relief to hotels and pubs, especially in the metros, which were forced to shut down following the ban. e Widespread relief The relief is palpable among these establishments as the court had in March 2017 clarified that the ban was not restricted to just liquor shops alongside the highways but also to other larger establishments, including pubs and hotels. The court had said that exempting establishments other than "shops involved in sale of liquor" which include bar-attached hotels, wine and beer parlours dotting highways would amount to dilution of its December 15 judgment's objective to prevent drunk driving, one of the major killers plaguing Indian roads. A Bench led by Chief Justice of India observed orally that the very purpose of the Supreme Court's ongoing intervention in the temple's management and affairs is to usher in sanctity and transparency. . SC. The opening of Kallara B to make an inventory of the valuables would hardly be a transgression of faith and sentiments. CJI made the observations when the Travancore royal family's lawyer and senior advocate Krishnan Venugopal informed the court that there was a tantri's report that Kallara B should not be opened as it concerned a matter of faith. 16. PAGE I: Selection of ECs must be transparent: SC Apex court advocates enactment of legislation to fill gap in Constitution Though so far the election commissioners (ECs) appointed have been "outstanding people, very fair and politically neutral," there is still a legitimate expectation that they should be selected through the "most transparent and just process" formalised in a law enacted by Parliament, the Supreme Court advised the Centre. The Bench pointed out that there is a "gap" caused by the lack of a parliamentary law which transparently spells out the process of appointment of an election commissioner "VVho should be shortlisted? who shortlists these names? What is the eligibility? . There is nothing to show the procedure followed in selecting them," Chief Justice observed. . He said that even the selection procedure of the CBl Director is formalised by a written law but not that of Election Commissioners.

  23. o Pradhan Mantri Fasal Bima Yojana (PMFSBY) has had better coverage and possesses several positive features but faces the same limitations as its predecessor, National Agricultural Insurance Scheme (NAIS).The only criterion for determining loss and distress remains the crop yield. Difficulties involved: 7T july 2017 Measurement of crop loss and loss in yield is time consuming, non-transparent and inaccurate. To overcome these shortcomings, the government has highlighted the use of remote-sensing technology, but professionals themselves are not sure on how remote sensing technology or other technologies that can replace the physical and time consuming Crop-Cutting Experiments (CCE) to estimate crop size and yields. Currently the scheme depends critically on CCEs. India has had some success with an alternate approach that uses weather as a proxy. The Weather-Based Crop Insurance Scheme (WBCIS) has been under implementation in some parts of the country since 2007 WBCIS provides insurance coverage to farmers in the event of failure of crops resulting from incidence of adverse conditions of weather parameters such as rainfall, temperature, wind speed, frost, humidity etc. . Unlike the PMFSBY, this is not yield-based insurance, but rather uses weather parameters asa proxy' for crop yields in compensating affected cultivators.
