Page-l: SC stays cattle sale rules across nation . The S.C.bench said government had received a "large number of representations'" that "certain aspects" of the Prevention of Cruelty to Animals (Regulation of Livestock Markets) Rules, 2017 and the Prevention of Cruelty to Animals (Maintenance of Case Property Animals) Act. 2017 were "troubling" and threw up some "sensitive" questions about the Central rules. . The petitions also noted that only state governments were empowered to make laws on cattle markets and fairs, which rendered the new rules arbitrary, illegal and unconstitutional. These rules were to be implemented in the next three months, and introduced lots of paperwork for cattle traders who are mostly poor and illiterate For instance, before the trade, both seller and buyer will have to produce identity and farmland ownership documents After buying a cattle, a trader must make five copies of proof of sale and submit them at the local revenue office, the local veterinary doctor in the district of the purchaser, animal market committee, apart from one each for seller and buyer. . Take an undertaking that the animals are bought for agriculture purposes and not for slaughter under the Prevention of Cruelty to Animals (PCA) Act of 1960 that gives the Centre powers over animal welfare.

. The 1892 and 1924 pacts between the erstwhile Mysore and Madras governments reflect an "inequality of bargaining power" and a lack of "conscience" which have no validity after the birth of the Indian Constitution, Karnataka argued in the Supreme Court. . The submission was made before a three-judge Bench during the day-long hearing on the appeals filed by Karnataka, Tamil Nadu and Kerala against the final award on the Cauvery Water Dispute Tribunal's decision on water-sharing. . Karnataka counsel submitted that the 1892 agreement, the parent of the 1924 pact, dictated that the Mysore govt could not develop any irrigational project on the river without the consent of the Madras government. . The marathon hearings were fixed after the Supreme Court had earlier refused the Centre's stand that the apex court lacked jurisdiction to hear the Cauvery river dispute. It had upheld the constitutional power of the court to hear the appeals filed by the three States against the tribunal award.
The Centre had argued that the parliamentary law of Inter-State Water Disputes Act of 1956,coupled with Article 262 (2) of the Constitution, excluded the Supreme Court from hearing or deciding any appeals against the Cauvery Tribunal's decision. The Bench, however, had held that the remedy under Article 136 was a constitutional right. The present year saw party states like Tamil Nadu and Karntaka (Cuavery basin), Goa- Karnataka-Maharashtra (Mahadayi) and also Odisha and Chhattisgarh (Mahanadi) sparring over sharing river water Constitutional Framework for resolving the water disputes: If a State Government makes a request regarding any water dispute and the Central Government is of opinion that the water dispute cannot be settled by negotiations, then a Water Disputes Tribunal is constituted for the adjudication of the water dispute. www.unacademy.com/user/studiousjatin
Article 262 in The Constitution Of India 262.Adjudication of disputes relating to waters of inter State rivers or river valleys (I) Parliament may by law provide for the adjudication of any dispute or complaint with respect to the use, distribution or control of the waters of, or in, any inter State river or river valley (2) Notwithstanding anything in this Constitution, Parliament may by law provide that neither the Supreme Court nor any other court shall exercise jurisdiction in respect of any such dispute or complaint as is referred to in clause ( 1 ) Co ordination between States. Water is a State subject as per entry 17 of State List and thus states are empowered to enact legislation on water. . Entry I7 of State List deals with water i.e. water supply, irrigation, canal, drainage, embankments, water storage and water power. Entry 56 of Union List gives power to the Union Government for the regulation and development of interstate rivers and river valleys to the extent declared by Parliament to be expedient in the public interest.

The Enforcement Directorate (ED) has received a databank of about 1.16 lakh companies from the Serious Fraud Investigation Office (SFIO), 16,000 of which are confirmed non-trading en- tities. . However, there are concerns whether the ED, at this stage, is empowered to initiate action against them even when they are found to be indulging in money laundering . As per the existing Prevention of Money Laundering Act (PMLA), the ED cannot on its own proceed with money laundering investigations till any primary agency, be it theCBl, the Income Tax Department, the SFIO or the State police, institutes a case under provisions that are listed in the Act's schedule under provisions that arelisted in the Acts schedule. .
