Anti Defection Law which was enacted with aim to check frequent defections by legislators in the light of "AayaRam GayaRam " culture has proved to be irrelevant in small states. Small states have less number of legislative assembly seats due to which in case of fractured mandates horse trading of even a handful number of MLA's can make or break the regime.As a result this option is resorted to by opposition parties.This was illustrated in recent events in states of Uttarakhand, Arunachal Pradesh and Nagaland. Sometimes defections can also be a political tool by centre to dissolve the assemblies lead by opposition parties in states using president rule as alternative or smelling the election air in their favour. However these can't be the only reasons for failiure of anti defection law. Infact the strictness and arbitariness of anti defection law can itself be the cause of its failiure. This law mandates legislators to abide by their party's whip and kills their freedom of conscience as they ought to submit themselves to the diktat of party leaders.Thus frequent suppressions can lead to defections by them as seen in case of Uttarakhand where defection was done by one-fourth of MLA's and in case of Arunachal Pradesh where speaker's role was questioned. Time is ripe now to review this law.Reforms like reviewind decision making power of speaker, limiting of whips issued by political parties claering of arbitary phrases like "voluntarily giving up membership" can dimish the preexisting tendency of indian politics to be power driven.

answer - Anti defection laws Anti defection law has particularly failed in ensuring the stability of govts, in various states govt in recent past , and moslty in Smaller states where 1 or 2 members can be the game changer of the entire political situtation and for stable government. in the recent election conducted with in 5 states where few political parites secures majority seats in larger states in comparison with smaller one like manipur and goa where number of seats requried even less than 14 or 15 and sitution is even wrose when running govt feels unsafe or unstable while funcitoning its business in the states liike Nagaland where recent govt headed by Sherhozile has became unstble when his opponent wrote letter to Governer of the state to allow him to form govt as he secures 41 seats to form majority govt . these kinds of situtation arises in the smaller states much more frequently in comparision with larger when because number of seats to secure majority is less and here Independent ministers, nominated members plays key role to form a govt as 52nd amendment acts have lesser strict provisions for Nominated member who can join any political party within the 6 months of his joining inthe house . In case of nagaland we can se since feb new govt is form but within 6 months uncertainity occurs. there are strict provision the Defection law where the memberships of the minister abolished as per the provision in the law, but this Defection law faces various critisism since the date of its introduction as; 1. Independent ministers can provide support to any political party after the result of election before forming the govt without joining any political party. 2. Nominated members can join poltical party within the 6 months of there mermbership in the house. becasue 52nd amendment act provides this provision to the nominated member its a previlage sometimes used unethically. 3.Anti defectioin law does not prohibits when by majority of 2/3rd members of any political party joins any other party to form govt.this happens in case of regional parities haveing lesser number of members in house. so we can say that in recent past Anti defection law has failed to in ensuring stabiltiy of govt in smaller states but at the same time since the inception of this law it has provided stable govts at union level where the game of coin is not just so easy as it is in the state level.... jatin please check my answer please review this ..i am waiting

meaning of mutation is correct but bacteria mutation is yet not discovered completely.. yeah.. you can say. about mutation in bacteriophage T4 n all .. bacteriophage (bacterial virus ...in layman's terms..) :)
