Maharashtra became the first Indian state to launch a special awareness drive to ensure that transgenders in the state register as voters. The state branch of the Election Commission of India (ECI) has launched the drive on April 15, celebrated as Third Gender Day (TGD). According to ECI officials, Maharashtra has over 10 lakh transgenders and only about 1,700 are registered voters. It must be noted that the ‘third gender’ status for hijras or transgenders was created by the Supreme Court in its landmark judgment on 15th April 2014.

This legal fiction of deeming him to continue in the party post-election as an "unattached member" makes him therefore vulnerable to disqualification from the House on the ground of defection under the Tenth Schedule (anti-defection law) of the Constitution In August 2016, the Supreme Court refrained from adjudicating the constitutional question in expelled Samajwadi Party leaders Amar Singh and Jaya Pradha's case. At the centre of the controversy is the Supreme Court's interpretation of paragraph 2(1) of the Tenth Schedule in the Viswanathan judgment of 1996. The court held that even if a member was thrown out or expelled from the party. He would continue to belong to that political party even if he was treated as "unattached." The court had held that the act of voluntarily giving up the membership of the political party may be either "express or implied." . . The Tenth Schedule (the Anti-Defection Act.) * The law was added via the 52nd Amendment Act, 1985 The grounds for disqualification under the Anti-Defection Law's are as follows a) If an elected member voluntarily gives up his membership of a political party; b) If he votes or abstains from voting in such House contrary to any direction issued by his political party or anyone authorised to do so, without obtaining prior permission
