Awareness of Article 60

Article 60 deals with the oath and affirmation by the President and the oath of the President is administered by the Chief Justice of India.

Before the appointment of the governing entities into their respective office they must take an oath.  It is the same for the position of president. The oath and affirmation by the president are mentioned in article 60 of the constitution of India. Article 60 also states that the process of administering the proceeding of the oath-taking process for the position of the president’s office. It also states that in absence of the president any individual taking the position of the acting president will also have to take the same oath and affirmation as guided in Article 60. 

Affirmation by the president: discussion

The position of the president is a highly prestigious post. The president of India shoulders responsibility for various crucial scenarios. Therefore, the president of India must work with diligence and honesty. Most of the crucial governing positions that deal with the administration of the processes required take an oath that addresses their responsibility and is dedicated to the governance of the country.  Similarly, the president of India is also required to take an oath in the name of god or solemnly affirm orderly constitutional proceedings.  

  • The president affirms that he or she will faithfully execute all offices of the president and will execute their duties with complete honesty.

Judge of the Supreme Court 

The individual who is appointed for the position of the President of the country needs to take an oath and affirmation. This ceremony of the oath-taking process is administered by the Chief Justice of the Supreme Court. The President of India holds the office of enough responsibilities and duties that requires diligence and dedication to the country and the countrymen. The president is elected with various forms of executive and authoritative powers and just like any other position in the government with enough importance in contributing to the administration and functioning of the policies of the country, they are required to take an oath and affirmation. 

Similarly, the president also takes an oath and affirmation which is administered by the Chief Justice of the Supreme Court. The Chief Justice of India administers the oath ceremony of the president of India. In the absence of the Chief Justice of India, the oath of the president is observed by the senior-most judge of the Supreme Court. 

Discharging the functions of the president: discussion 

In adherence to the President (discharge of functions) Act, 1964, the president is discharged of his or her duties from the office. A president has a certain extent of legal immunity during his or her tenure in the office and is also susceptible to getting impeached. However, it occurs very rarely. The president is generally discharged by the end of their tenure. There are however different scenarios under which a president can be discharged.

  • A president is discharged of their duties upon his or her death
  • A president is also discharged upon their resignation.
  • The president can be removed by impeachment
  • The president can also be removed by the Supreme Court of India. 

In case of discharging the function of the president, the immediate individual who is taking over the position of the president requires to take the same oath as that of the president which is stated under Article 60.

It also mentions the servitude and dedication of the President towards the country and its citizens. This oath is administered by the Chief Justice of India. Upon the discharge of the President of India, the other acting president will have to take the same oath as mentioned in the article.
