A bill is a legislation proposal which is put in the consideration by the legislature and the president. In other words, it is a draft of the law which is yet to be passed by the parliament and the president to finally be called as a law.
In India, a bill has to go through three readings after which it is put for the assent of the president as a final step. Let’s discuss the important concepts and facts related to the bills one by one.
Types Of Bills
Legislative procedure is initiated in the form of a bill. When a bill is agreed upon by both the houses of parliament and assented by the president, it becomes a full-fledged law. Bills introduced in the Indian parliament can be classified into four types of bills. These four types of bills are as follows:
Money Bills:
These bills are cited in article 110 of the Indian constitution. These bills deal with the matters including taxation, borrowings, consolidated & contingency funds, auditing, assurance & accounting, etc
A money bill can only be introduced in Lok Sabha on the recommendation of the president. Though the bill is sent to the Rajya Sabha also after it is passed in the Lok Sabha
Even if Rajya Sabha rejects (or returns) the bill, the bill is deemed to be passed. Annual financial bill (or budget) is an example of a money bill
Financial Bills:
A bill which deals with the matters of revenues & expenditure but has not been certified as a money bill is known as a financial bill
Like money bills, financial bills too can only be initiated in Lok Sabha on the recommendation of the president but need to be passed by both houses of the Indian parliament (Lok Sabha and Rajya Sabha) by simple majority
Financial Bills are of two types- one is “Financial Bill Type I” and the other is “Financial Bill Type II”
Constitutional Amendment Bills:
These bills are cited in article 368 of the Indian which confers upon it the power of parliament to bring changes in the constitution
These bills can be initiated in any of the two houses without the recommendation of the president
Such bills must be passed by each house separately with a special majority i.e., 2/3rd of the total voting members)
After the implementation of the 24th Constitutional Amendment Act, 1971, it is obligatory for the president to give his assent to the constitutional Amendment bills
Ordinary Bills:
Ordinary bills deal with any matter other than those dealt in financial bills, money bills, constitutional Amendment bills
Such bills can be initiated in either house of the Indian parliament without the recommendation of the president
These bills are passed by simple majority in both the houses
