Narcotic Drugs and Psychotropic Substances Amendment Bill, 2021

A formal change that can affect the law that requires due to a situation comes from a violation of the previous act. The primary motive under rectification of the bill is used to make the development of the act that can handle different issues related to crime. The situation of modification of the existing knowledge is related to the demand for amendment. The construction of the amendment seems to change the legal documents.

An Overview of Narcotic Drugs and Psychotropic Substances (NDPS) Bill

The Act of regulation can make different operations that are related to manufacturing, consumption and transportation that are related to the substances of the drugs and psychotropic. The NDPS bill has been introduced for the first time in 1985 and later different clauses have been amended in different years. In the Act of NDPS, the Indian parliament has stated the prohibition of cultivation/production, sale, processing, purchasing, transportation, and consumption of any substance of psychotropic or narcotic drug. A drug that is utilised by consuming in different forms to affect the way the human brain works behaviour, mood, thoughts, and feelings. There are different instances of psychotropic substances such as marijuana, caffeine, alcohol, and nicotine. 

About the Information Related to Amendment regarding NDPS Bill

The amendment of the NDPS bill proposed in 2021 as the ordinance promulgated information related to the 2014 amendment Act has faced some drafting errors. The term ‘illicit traffic’ was introduced by the application of the sub-clauses in Section 2. The changes have been proposing in section 27(A) has been determined by the NDPS Act to need an amendment for the construction of penalties regarding the trafficking of illicit. The addition of the sub-clauses (i) to (v) with Section 2 of (viii-a) has been suggested by the higher court of Tripura.

According to the constitution of India, the Indian Parliament has the access to make rectification of bills. The court and government can propose the requirement of changes in the bills by finding the available gaps according to the current circumstances. Moreover, different situations have proposed the urgency of changing the NDPS bill after the amendment of 2014. The finance minister of India has proposed the necessary modification of the existing bill regarding the penalty by replacing the ordinance by mentioning the quotation of the higher court of Tripura. The amendment of the NDPS bill was announced publicly on September 30, 2021. 

Features of NDPS Bill

There are different objectives and concerns available based on the amendment of the bill in 2021. The followings are the different objectives:

  • To assist the victim of drug abuse by providing support and rehab

  • To decriminalise custody of the person who has used drugs in a very limited quantity

  • To make more restrictions on the trafficking of drugs

  • To make regulations related to the drugs consumption and the substances of psychotropic

Importance of NDPS Bill

The NDPS bill is concerned with the amendment of the different provisions for managing the criteria of the several factors. According to the NDPS (Amendment) Act 2021 it has been proposed that the violation of the bill will be considered as the criminal provisions which will make the actions based on the law in India. Manufacturing, selling, and trafficking are the elements that are associated with the penalty in this present amendment act. The government has announced the Drug-free India campaign that will make focus on the community program. 

Conclusion

Conclusively, a different amendment to the Act has been published in 2021 to the last amendment made in 2014 regarding the NDPS Act. In different times, the Indian government or any higher court from the districts of India can suggest the required changes in the available Act to make the rectification. The different situations can make the court forcefully present the legislation that has been required due to the misconduct of the present law. The gaps found in the legislation made the Parliament act on this.
