About Council of Ministers (COM):
- Article 74 of the Constitution provides that there shall be a COM, headed by the Prime Minister (PM) to aid and advise the President.
- As per the 91st Constitutional Amendment Act 2023, the total number of ministers, including PM, in the COM shall not exceed 15 per cent of the total strength of the Lok Sabha.
- The Union Territories of NCT of Delhi and Jammu & Kashmir (J&K), the maximum limit is 10% of the total strength of its Assembly.
- There is no minimum requirement at the Central level whereas even the smaller States should have a minimum of 12 Ministers.
- The COM consists of a Cabinet minister, Minister of State (MoS) with independent charge, MoS and a Deputy Minister.
- Constitutional provisions pertaining to the COM:
- Article 74: Council of Ministers to aid and advise the President of India.
- Article 75: The Prime Minister shall be appointed by the President and the other Ministers shall be appointed by the President on the advice of the Prime Minister.
- Article 77: Conduct of business of the Government of India.
- Article 78: Duties of the Prime Minister w.r.t. the furnishing of information to the President, etc.
- Article 88: Rights of Ministers w.r.t. the Houses.

- Oath and Salary of Ministers:
- The Union Council of Ministers (CoM) Ministers are administered the Oath of Office and the Oath of Secrecy by the President of India.
- Salary: The salaries and allowances of the Council of Ministers are determined by Parliament from time to time.
Why in the News?
- The Union Council of Ministers, led by the Prime Minister, was recently sworn in on June 9, 2024. It includes the Prime Minister, 30 Cabinet Ministers, 5 Ministers of State with independent charge, and 36 Ministers of State.
