  2. Question 7 (Case 1) 7. Rakesh is a responsible district level officer, who enjoys the trust of his higher officials. Knowing his honesty, the government entrusted him with the responsibility of identifying the beneficiaries under a health care scheme meant for senior citizens. The criteria to be a beneficiary are the following: (a) 60 years of age or above. (b) Belonging to a reserved community (c) Family income of less than 1 Lakh rupees per annum (d) Post-treatment prognosis is likely to be high to make a positive difference to the quality of life of the beneficiary. One day, an old couple visited Rakesh's office with their application. They have been the residents of a village in his district since their birth. The old man is diagnosed with a rare condition that causes obstruction in the large intestine. As a consequence, he has severe abdominal pain frequently that prevents him from doing any physical labour. The couple has no children to support them. The expert surgeon whom they contacted is willing to do the surgery without charging any fee. However, the couple will have to bear the cost of incidental charges, such as medicines, hospitalization, etc., to the tune of rupees one lakh. The couple fulfils all the criteria except criterion "b'. However, any financial aid would certainly make a significant difference in their quality of life. How should Rakesh respond to the situation? (250 words)

  5. Ethical Dilemma in this case is: Strict observation of the organizational rules and processes and deny benefits to Old man. Values of compassion and empathy towards weaker section of society and thus tweak rules to help genuine case of old man. 1. 2. MANAGE ETHIC

  6. Various course of action: 1. Deny entitlements to old age couple as they do not fulfil entire criteria. Merits: 1. Upholding rules and processes. 2. Protecting right of reserved class. 3. Honesty and integrity of the office will be intact and may lead to promotion and career growth of Rakesh. Demerits: 1. Life of Old man may be in jeopardy. 2. Denial of Public services just on basis of reservation, when an Individual may have very high chances of survival is against ethos of Humanity Any negative outcome due to service denial may lead to public outrage, compromising law and order It will further consolidate public perception of Bureaucratic red tapism 3. 4. t conscience in Rakesh for not able to help old man will affect efficiency and career.

Citizen centric administration Old man will be able to get life saving timely medical intervention. Two lives can be protected as old man wife is solely dependent on Old man. Demerits: 1. Breaking of law will set wrong precedence. 2. May open flood gates for other cases thus robbing reserved community of their due share.

Ask any NGO working in health sector to come forward and arrange for funds Merits: Will be able to reconcile conflicting values of compassion and organizational rules Demerits: 1. It may take time and situation of old may worsen. 2. Reflect timidity and consolidate Bureaucratic mindset towards blind following of the rules.

Compassion and empathy for poor and marginalized are cornerstone of Public service values .A Public servant is expected to follow rules but also use his discretionary power out of good faith and enlightened Public Interest. When life of an Individual is at stake results outweigh Process and rules .However, Rakesh must intimate regarding his decision to Higher authority Rakesh should also make complete documentation of the case and send to Secretariat level where Policies are made, so that such suitable amendments can be made in the policy , benefitting many other genuine cases like this one.
