  4. SOCIETY AND RELATED ISSUES

  5. Media Censorship (EPW) Context-GOI's decision to ban Hindi news channel NDTV India for an entire day (put on hold) as punishment for coverage of terror attack on Pathankot Military base .Ever since Mumbai attacks As per Cable TV Networks (Amended) Rules-No live coverage of anti-terror operations and coverage be limited to periodic briefings by GOl, else a broadcast blackout extending up to 30 days Issues Freedom of speech and expression v/s national security

  6. Freedom of Speech is NOT ABSOLUTE ls it 'indirect censorship' or protection of 'national security' Body tasked with deciding the transgression by a channel is Inter-Ministerial Committee comprising govt officials and none from journalist background in it Why only NDTV India?

  7. NDTV-only reported about anti terrorist operations, but had not shown anyscenes of security forces chasing or fighting with terrorists. So no live coverage Channel broadcast a report that stated that two terrorists were alive and were very close to ammunition depot. The government said this gave away sensitive information NDTV -such information already in public domain, already reported by newspapers and by other channels Self-regulation is the key in democracies

  8. POLITY AND GOVERNANCE CONSTITUTION OF INDIA

  9. Cauvery Dispute-TIMELINE (Hindu) Madras Presidency and Mysore State -agreements related to water division that lapsed in 1974 SC-Centre to constitute Cauvery Water Dispute Tribunal, a demand by TN bto ontftute Cauvery Water Di 1990: Centre notifies Cauvery Water Disputes Tribunal CWDT-interim award: Karnataka ordered to release water. Karnataka passes an ordinance but SC upholds interim award of the CWDT

  10. Cauvery Dispute-TIMELINE (Hindu) Centre constitutes Cauvery River Authority for implementation of interim award . . 2007: Cauvery Water Disputes Tribunal final award afer DISPUTes Tribunal final awar Tribunal-valid two agreements between Madras and Mysore on apportionment of water to Tamil Nadu It didn'tstate the sharing mechanism in 'distress years' when Cauvery flow was less

  11. Should SC intervene? (EPW) Court's decision mandating setting up of Cauvery Management Board is facing resistance on ground that Court has no authority to issue such directions against provisions of Interstate River Water Disputes Act, 1956 Criticised for ordering arbitrary amounts of water to be released Resolution in such cases always a political settlement & not legal .262 allows Parliament to deprive SC of its jurisdiction to hear such disputes Issue is long sagas that continue in political settlements (For e.g. SYL issue) whereby even political solutions aren't permanent and inevitably find ways to courts for resolution
