Removal of President from Service

Impeachment is a process of charging a crime and violation of the constitution and the president is removed before his tenure by impeachment.

Impeachment is related to questioning the integrity and authenticity of some actions or decisions. Mainly the term and the concept of impeachment indicates team decision based on some incidents, decision, action and it can remove the person with authority from his position. The process of impeachment is dependent on the masses that are providing their statements on the selective area. The entire process related to decision-making for removing a person from his/her position is known as impeachment. It usually comprises the President, courts, and other authorities from constitutional positions.   

The concept of impeachment

Impeachment is a process that is initiated for violation of the Constitution and for that team decision comprising the President, judiciaries, and other positions with the legislative authority to take decisions collaboratively. In different nations, impeachment takes place by the initiation of the federal president and the constitution’s policies for the republican government. The impeachment is related to maintaining the charge of misconduct and outer political movements that breach the policies from the constitution made against the public officials and officers.

Impeachment in India 

In India impeachment is used for two specific areas. The first factor is the impeachment of the President and the other context is the Supreme Court judge’s impeachment.

Impeachment of the President of India

By the process of impeachment, no president so far has been banished; however the procedure is still in place to deal with the law by land. There is the chance of impeachment only when a president takes unethical actions, shows disrespect towards the constitution, and misbehaves by violating the legislative areas of the Indian constitution. The process is impactful and it has the authority to remove a president from his/her position and takes away all the authority because of the disrespect and violation of the constitution. The process of eviction can take place within two hours. Either the house of Parliament or higher officers take decisions by addressing the charges against the president and the quarter member from the full house signs the petition. Later, the notice is sent to the President, and actions are taken within 14 days.    

Impeachment of the Judges 

Either the house of Parliament or the authoritative officials who manage the disciplinary areas in judiciary decisions initiate the impeachment process. Through the collaborative decision, the process related to justice is being initiated even for the higher authorities like Supreme Court judges.       

The procedure of impeachment

The procedure of Impeachment in India comprises multiple strategies and with selective steps, decisions are taken. Evicting the president from his/her respective position and questioning the jurisdiction of the decision-making and eliminating him from their respective roles are the most authoritative areas presented in the constitution. First, the house of parliament takes the decision about the eviction of the president and the Supreme Court judge. Later, the aspects that portray the areas against the president are noted. The house members label the charges one by one and a minimum of a quarter of the members signs the notice. After this process, the notice is delivered to the president by giving him a warning about his deeds and with the decision taken by the house members. After the acceptance of the letter, the president of India and the judge are provided with 14 days to submit their resignation from their respective position.

Impeachment is a process that is a legislative action taken by the higher authority of the Indian government. Only the president and Supreme Court judges could be part of the impeachment. The impeachment of the president is initiated by either the house of Parliament or the house members but for the justice impeachment by the Supreme Court it only could be removed by his officers but it requires the approval of the House of parliament. By using voting and collaborative decision the ultimate eviction could be initiated. In order to maintain an independent judiciary and integrated authority, impeachment is initiated.
