KNOW THE NEED FOR FUNDAMENTAL DUTIES

Fundamental rights and responsibilities refer to moral obligations that all people of India need to follow. There are mainly 11 fundamental responsibilities in the country which are added in Part IV-A of Indian Constitution in terms of strengthening unity and promoting patriotism.   The study is going to focus on the fundamental rights and duties as well as the importance of fundamental responsibilities. The fundamental duties of the Indian Constitution assist in protecting sovereignty, unity and integrity. 

Analysis of fundamental duties

The people of India belong to different castes, creeds, religions and to maintain harmony and peace, the fundamental rights and duties play a critical role. The fundamental duties were effectively included in Part IV-A of the Indian Constitution through the “Constitution (42nd Amendment) Act, 1976” during the Emergency of Indira Gandhi. “Article 51(A)” defines 11 fundamental duties in which 10 came through “42nd Amendment” and 11th duty was effectively added in 2002 through 86th Amendment during the time of Atal Bihari Vajpayee. However, the fundamental responsibilities were appropriately incorporated in the Constitution of India through 42nd amendment with 11 duties that every people of India need to follow, such as:

• Respect for national anthem as well as national flag
• Adhere to the ideals of freedom struggle
• Protect integrity and sovereignty of India
• Protect the country and provide national assistance when called upon
• Preserve composite culture
• Spirit of common brotherhood
• Strive for excellence
• Safeguard public property
• Develop scientific temper
• Preserve natural environment
• Send the children to school between the ages of 6 to 14 years.    

Fundamental duties can be defined as moral responsibilities for all people of India in terms of protecting sovereignty, unity and integrity. These duties assist to maintain harmony and peace as well as encourage the feeling of brotherhood. Deficiency of awareness regarding fundamental duties decreases the effectiveness among people. The fundamental duties and rights are effectively applicable for all people of India despite the elements and the factors of race, caste, gender, as well as religion. There is an effective criticism on the factors of fundamental rights and duties such as lack of clarity, excessive limitations, and lack of awareness.

The 11 fundamental rights are effectively mentioned in “Part IV A” of the Constitution of India under Article 51A. These duties can be effectively controlled and maintained in any condition. The nature of these duties relies on economic, social as well as political. Indian Constitution can be described as an effective and longest written constitution and sets out directive principles, duties of citizens as well as fundamental rights. In the present scenario, the fundamental responsibilities assist in reducing the factors of democracy as well as protecting sovereignty, unity and integrity. The 11 fundamental duties and rights play a vital role in providing equal opportunities and maintaining peace among all people.

Effective awareness regarding the importance of fundamental duties can assist to maintain harmony and peace and encourage the feeling of brotherhood. Being a citizen of India, there is a requirement for effective and appropriate maintenance of fundamental responsibilities. Appropriate commitment of government helps in developing trust among the citizens of India towards Indian Constitution and protecting sovereignty, unity and integrity.  There is an essentiality of these duties as it assists the courts in determining and examining the constitutional validity of acts and regulations.

There are primarily 11 fundamental responsibilities that the people of India need to follow and maintain. Moreover, it can be stated that the fundamental duties are effectively confined to the people of India and there is no appropriate legal sanction against the non-maintenance activities of fundamental duties.
