Recently, the Calcutta High Court declared the 'Duare Ration Scheme' of the West Bengal government “ultra vires to the National Food Security Act, 2013” and legally void.

Why in the News? 

Recently, the Calcutta High Court declared the ‘Duare Ration Scheme’  of the West Bengal government “ultra vires to the National Food Security Act, 2013” and legally void.

Key Points:

Background: 

  • The Duare Ration Scheme asked the shopkeepers to distribute the ration to the beneficiaries doorstep. 
  • But under the National Food Security Act there is no such provision. 
  • So, The Shopkeepers have filed a case in Calcutta HC, pointing out that no such obligation has been mentioned in the NFS Act regarding distribution of ration at doorsteps. 
  • If Parliament amends this then it can be possible. HC has ruled in favour of the shopkeepers.

About the Duare Ration Scheme:

  • The scheme was introduced by the West Bengal government in November, 2021, for delivery of food grains under public distribution system at the doorsteps of beneficiaries.
