Directive Principles Of State Policy-Article 41

There are many articles in the Indian Constitution. These articles help in making sure that people are safe and healthy. Here we’ll discuss article 41.

DPSP or Directive Principles of State Policy has defined articles 36 to 51. These directive principles have been accumulated from the Irish Constitution. These principles mainly focus and talk about the protection, peace and security of the nation, which includes economic, socialistic, political, legal, and other aspects. All the articles are categorised into different features. Article 41 is a socialistic principle that is for the welfare of the people. These direct principles are not enforced in the court of law, as they were made because it was thought the states could implement them without many resources.

The Constitution of India does not refer to any categorisation of the State Policy Directive Principles. But still, the numerous Articles are grouped into three broad groups based on their content:

  • Principles of Socialism 
  • Gandhian Values and Principles 
  • Principles of liberal-intellectual liberalism.

Socialist Principle

The socialist principle is responsible for following the Socialism ideology. It lays down all the framework of the country accordingly. The main aim of this principle is to ensure that the country has economic and social justice among all its citizens. As a result of this, a state can easily fulfil the criteria to become a welfare state. The articles of DPSP that follows this principle of socialism are:

Gandhian Principles

The Gandhian principles are used to reflect the ideology of reconstruction. This ideology was propagated by Mahatma Gandhi, and it was a national movement. To make sure that Gandhi’s dreams are fulfilled, there are some concepts present in DPSP that were his concepts. These concepts help in directing a state. The articles of DPSP that are covered under this principle are:

Liberal-intellectual Principles

The last principle is the principle of Liberalism ideology. The articles of DPSP in this are:

  • Article 44

  • Article 51

Articles 41 of DPSP

This article mainly talks about the welfare government. According to this article, the state shall make some provisions that are effective to secure the right of work and other related things. Also, in old age, disablement, unemployment, or any other case with economic or developmental acts should have public assistance. Article 41 acts as a tenet for various schemes of social sectors that includes the right to food security, social assistance program, old-age pension scheme, and more.

As per the constitutional statement, it states the right to work, public assistance, and education in specific cases. The state is also supposed to make efficient provisions by staying within the economic and developmental limits. These provisions secure and protect the right to get an education, to work, and to get public assistance in those cases where there is sickness and disablement, old age, unemployment, or any other cases that have an undeserved want.

This article 41, was article 32 in the draft. This drafted article entered into a debate on November 23rd, 1948. During the debate, the amendment to have medical relief along with the social amenities listed in this was moved by one member. The same member also insisted that the phrase “undeserved want” should be rephrased to “deserving relief”. In the meantime, another member pointed out that this right to medical relief has been provided by Draft article 38, final article 47 of the constitution. So, it is not necessary to include the same again. So, as a result, this article was adopted without any amendments on the same day.

Conclusion

The DPSP makes sure that the States of the country are following all the rights and all the citizens are aware of the articles under it. All these articles are essential because it helps in the economic and social development of the country. Article 40 is to provide a basic fundamental right to people of the state, which is to get an education, to work, and to get welfare.
