About Model Code of Conduct (MCC):
- MCC is a set of guidelines issued by the Election Commission of India for political parties and candidates to maintain decorum in their campaigning.
- It lays down a list of dos and don’ts for leaders and parties ahead of elections.
- Duration: MCC comes into force from the date the election schedule is announced until the date that results are out.
- Legal Enforceability: MCC does not have any statutory backing.
Opinions on the Need for Legal Teeth in MCC:
- According to one perspective, the ECI has extensive authority under Article 324 of the Constitution to guarantee fair elections, thus legal enforceability is superfluous.
- Legal teeth might result in lengthy court cases, which could delay elections and disrupt the democratic system.
- The Constitution and current statutes provide limits on the ECI’s authority, thus its operations must adhere to them.
Why in News:
- The Model Code of Conduct (MCC) implementation during the Lok Sabha elections brought criticism towards the Election Commission of India (ECI).
