Jharkhand ups reservations for SC, ST, and others to 77%

The new developments come while Jharkhand is in the midst of a political crisis caused by the possibility that Chief Minister of Jharkhand Hemant Soren would be disqualified from his position as an MLA due to a case involving an office-of-profit violation.

Following the meeting, secretary of Cabinet Vandana Dadel announced that the Cabinet had approved a reservation bill to modify the Vacancies of Jharkhand under reservation in Act of Posts and Services 2001, to provide reservation of 77% for ST, SC, backward classes, or the other weaker sections of society and even the economically weaker sections.

Reservation for SC and ST

The state of Jharkhand has approved a plan to reserve 77% of state government employment for people from the Scheduled Castes, Scheduled Tribes, Other Backward Classes, and Other Economically Weaker Groups. Hemant Soren, the chief minister of Jharkhand, increased the quota for other backward classes from 14% to 27%. 

On 14th September the cabinet of Jharkhand which is led by honourable chief minister Mr. Hemant Soren passed two bills: one would use property records from 1932 as the foundation for a domicile in a state. The other bill would boost reservations for people who belong to weaker sections at the social and economic levels. The government of Jharkhand raises reservations for them up to 77%. The government of Jharkhand also agreed on the plan to utilise land records from 1932 to identify long-term residents.

The second measure approved by the cabinet would boost job opportunities for needy people. It can bring a great change in the life of the youth of Jharkhand who awaited a lot for career opportunities. This reservation quota can be a turning point to raise the employment rate of youth in the state.

The Chief Minister of Jharkhand Mr. Hemant Soren stated that although the administration is actively attempting to develop large-scale employment for native inhabitants including tribals in the state, the Opposition is attempting to add a political hue to matters such as domicile, OBC quota, and language. Soren made this statement in response to questions from the Opposition over the three problems that have recently acquired prominence in the state.

In response to BJP lawmaker Biranchi Narayan’s question on the government’s stance on the definition of sthaniya’ (locals), Soren lashed out at the Opposition, saying, “The whole state is protesting over the matter.”

Current Reservations

Currently, reservations under the OBC group account for 14% of all reservations. The community of Scheduled Tribes or ST has a reservation quota of 26%. The community of Scheduled Caste or SC has a reservation quota of 10%.

This new development took place in the midst of a political crisis in Jharkhand, which was sparked by the fact that Chief Minister Hemant Soren was being threatened with being disqualified as an MLA.

Additionally, the administration of the state would write a letter to the centre requesting that the measure be included in the 19th schedule of the constitution.

Reservation Division

At the meeting, it was resolved that the state government will submit a request to the central government to have the measure included in the 9th Schedule of the Constitution. The proposed employment reservation policy allocates 12% of the total available jobs to the community of SC and 28% to the ST community. 

The people who belong to extremely backward classes will get a reservation of about 15%. The remaining 12 & 10 presents will be beneficial to other backward classes and for the people belonging to economically weaker sections(excluding individuals from other protected categories), respectively. 

The Congress party of Jharkhand, which has been demanding for 27% OBC quota in government positions, has welcomed the move as a historic gesture that would reduce the need for people to go to neighbouring states in search of employment. The creation of a commission to provide recommendations on reservations for ST, SC, and the other backward classes was authorised by Soren.

The Constitution of India in its Article 46 states unequivocally that the state is obligated to protect the socially and economically underprivileged members of society, with a particular focus on the Scheduled Castes and Scheduled Tribes, from any form of oppression or exploitation, and to make special efforts to improve their educational and financial standing.

All the major political parties in the state have long demanded that the reserved quota be increased, especially for the people belonging to other backward classes or OBCs.
