Unacademy UPSC Assure – Terms & Conditions

1. The Unacademy UPSC Assure (“Program”) is a program organized by M/s Sorting Hat Technologies Private Limited (“Unacademy”) which offers certain benefits, including but not limited to an extension of subscription and/or a refund (each a "Benefit" and collectively "Benefits") to Learners in connection with their performance in the UPSC Civil Services Examination (Preliminary and/or Main, as applicable), conducted for the cycle(s) specified by Unacademy as eligible for the Program on the Platform ("Exam"), subject to Unacademy's UPSC Assure Terms and Conditions ("Program Terms") herein.
2. The Program shall be governed by these Program Terms as well as all other policies and terms and conditions (hereinafter collectively referred to as "Platform Terms") available on www.unacademy.com
3. Any capitalized term used but not defined herein shall have the meaning ascribed to it under the Platform Terms, and in the event of any conflict between these Program Terms and the Platform Terms, the Program Terms shall prevail unless expressly stated otherwise.
4. To be eligible for the Program, Learners must purchase the applicable UPSC Plus subscription for the duration specified under the terms of the applicable Offer ("Course"), during the offer period, on the Platform. The eligible Exam cycle, offer period, nature and quantum of the Benefit on offer, and any conditions attached thereto (collectively, the "Offer Terms") shall be as specified by Unacademy on the Platform from time to time, and Unacademy reserves the right to extend, modify, or vary the same at its sole discretion, with such changes communicated through the appropriate official channels.
5. The Program is applicable to all individuals who (i) are Indian citizens, (ii) reside in India, (iii) purchase a Course during the offer period, and (iv) are legally eligible to enter into a contract or fulfill the Age Requirements.
6. Common Eligibility Criteria: Irrespective of the Benefit sought, a Learner must, at a minimum: a) Have a minimum of 500 hours of watch time of Plus courses on the Platform;
   b) Have attempted a minimum of 50 live Prelims tests and 50 Mains tests on the Platform;
   c) Submit the admit card for the Exam, where applicable;
   d) Meet any additional or varied criteria as may be specified under the applicable Offer Terms.
   
7. Benefit-Specific Conditions: The following conditions shall apply in addition to the General Conditions above, depending on the nature of the Benefit offered under the applicable Programme:
a) *Extension*: Where the Benefit on offer is an extension of subscription, the same shall be available to a Learner who does not obtain the UPSC Qualifying Mark in the Exam, subject further to the Offer Terms, including any conditions on the gap between completion of the Course and the Exam, and the attempt(s) of the Exam in respect of which the Offer is available.
b) *Refund*: Where the Benefit on offer is a refund, the same shall be available only to a Learner who obtains the UPSC Qualifying Mark in the Exam, subject to the Offer Terms.
c) *Other Benefits:* Unacademy may, at its sole discretion, offer any other Benefit(s) in connection with the Program, in which case the eligibility criteria, conditions, and manner of availment for such Benefit shall be as specified under the applicable Offer Terms.
8. Once the results of the Exam are declared, Learners seeking to avail a Benefit may contact Unacademy learner support through the options enabled on the help and support page of the Platform, within the timeline specified under the applicable Offer Terms.
9. These Program Terms constitute the general framework governing the Program. In the event of any conflict or inconsistency between these Program Terms and the Offer Terms published on the Platform in respect of a specific Offer, the Offer Terms shall prevail to the extent of such conflict or inconsistency, solely in relation to that Offer.
10. Verification, Validation, and Fraud Prevention: A Learner seeking to avail a Benefit shall be required to fill a form and/or submit such documents, information, or details as may be requested by Unacademy, within the timeline prescribed by Unacademy ("Verification Details"). Unacademy shall be entitled to independently verify and validate: (i) the authenticity and accuracy of any Verification Details submitted; (ii) the Learner's watch time, test attempt records, and other platform activity from Unacademy's own systems and records, which shall be treated as conclusive for this purpose; and (iii) compliance with the Common Eligibility Criteria and the applicable Benefit-Specific Conditions and Offer Terms.
11. Unacademy shall be well within its rights to reject the Learner from the Program or Offer, or to claw back/reverse a Benefit already extended, if: (a) the documents or details provided by the Learner are invalid/incorrect/incomplete/misleading/untrue or not acceptable in the opinion of Unacademy; (b) the Learner has not conformed to any of the terms and conditions contained herein; (c) the Learner does not sign the consent form or any other documents required, if any, by Unacademy concerning the Program; (d) the Learner has engaged in any fraudulent activity, manipulation of watch time or test-attempt metrics, or other misrepresentation, as may be determined by Unacademy in its sole discretion; or (e) any other reason as may be deemed appropriate by Unacademy. The Learner shall be barred from participating in any future programs at the sole discretion of Unacademy.
Any Verification Details submitted by the Learner shall be processed in accordance with Unacademy's Privacy Policy.
12. General Disclaimers:
a) Unacademy does not accept any responsibility for any incorrect and/or incomplete communication details provided and/or delay in receipt of communication and/or non-receipt of communication. b) The decision of Unacademy on all matters pertaining to the Program, including determination of eligibility, verification outcomes, and instances of fraud, shall be final and binding on all parties. c) Unacademy shall have the sole discretion to discontinue/cancel/modify the Program Terms, the Offer, or any Benefit, or any part thereof, at any point in time, and the Learner shall not raise any claim due to such discontinuation, cancellation, or modification at any time whatsoever. d) Unacademy shall not be liable for any loss, claim, damage, or expenses whether expressed, implied, real, or consequential incurred by the Learner due to participation, non-participation, or otherwise in the Program. Unacademy shall not be responsible for paying any applicable taxes, fees, charges, etc. related to the Offer. e) The Learner shall indemnify Unacademy against any claims from any party and consequent losses, damages, or compensation, whatsoever, that may arise from any use, including but not limited to, the publication of response(s) submitted by the Learner as a part of, or in association with, the Program. f) Unacademy shall not be liable for any failure to comply with its obligations caused by weather conditions, fire, flood, strike, hurricane, industrial dispute, war, hostilities, terrorist attack, political unrest, riots, civil commotion, inevitable accidents, acts of God, or any other circumstances amounting to Force Majeure. Unacademy shall not be responsible for any loss or damage if it has to discontinue or cancel this Program in compliance with any law, ruling, order, regulation, requirement, or instruction of any Central/State Government, or for any other unavoidable reason beyond its control. The Learner(s) shall be informed of such discontinuance/cancellation as soon as possible. g) The aggregate liability of Unacademy in case of any damage, loss, cost, claim, liability, or expense (including legal costs and expenses) caused to or incurred by any act, omission, or representation arising out of this Program shall not exceed the Subscription Fee actually paid by the Learner for the Course in respect of which the Benefit was sought h) Unacademy shall not be responsible for any errors or omissions in the Program Terms contained herein. All information provided is provided "as is" without warranty of any kind. To the fullest extent permitted by applicable law, Unacademy disclaims all warranties, express or implied, including without limitation, implied warranties of merchantability, fitness for a particular purpose, and non-infringement in respect of the Program. i) Participation in the Program is voluntary and Unacademy does not charge any registration fee for the same. The Program is being made available purely on a best-effort basis. j) Any disputes with respect to the Offer shall be governed by and construed in accordance with the laws of India, without reference to principles of conflict of laws, and the courts in Bangalore shall have the exclusive jurisdiction to determine any disputes arising out of, under, or in relation to, the Program.
