CONSTITUTIONAL POSITION o Both governor and President have situational discretion. o Cases requiring situational discretion of the Governor: o Appointment of the CM when no party has a clear-cut majority in the state legislature or when the CM dies suddenly without an obviouS successor o Dismissal of the council of ministers when they cannot prove confidence of the statke legislative assembly o Dissolution of the state legislative assembly if the council Loses ma jorit,


  5. CONSTITUTIONAL POSITION o The governor has some special responsibilities according to the directions issued by the President. She has to consult the council of ministers, then finally act in her discretion. The responsibilities are: Maharashtra: establishment of separate development boards for Vidharba and Marathwada. Gujarat: establishment of separate development boards for Saurashtra and Kutch


  6. CONSTITUTIONAL POSITION o Nagaland: w.r.t. Law and order in the state while internal disturbances in the Naga Hills-Tuensang Area continues o Assam: w.r.t. administration of tribal areas. Manipur: w.r.t, administration of the hill areas in the state


  7. CONSTITUTIONAL POSITION o Sikking: for peace and for ensuring social and economic advantage of the different sections od the population Arunachal Pradesh: w.rk. Iaw and order in the stat o Karnataka: establishment of separate development boards for Hyderabad-Karnataka region


  8. CONCLUSION o Governor has been assigned a dual role by the Constitution constitutional head of the state o Representative of the Centre in the state.
