Ashna you are doing very great job.Thanks for giving such kind of quality lessons,you are covering almost all imp points in laxmikanth's .Here i have a question for you, could you please clear that? the power of the president was not subjected to judicial except under the decision of irrational or mala fide, or arbitrary as per the subject.Here how can we identify or how do we know that the president's decision is irrational ,arbitrary so on and so forth...Could you give any kind of thing that could happen in past otherwise a live example if any??Thank you very much in advance.....

Let me take a case here, In Kehar Singh vs. Union of India AIR 1989 SC 653, the supreme court observed that judicial power and the presidential power to pardon are totally different. The power of pardon cannot ordinarily be subjected to judicial review except on very narrow grounds mentioned in Maru Ram's CASE (which stated that considerations of excercise of power under art 72 / 161 can have various reasons eg. Humanitarian consideration and is not limited to the public good). However in Maru Ram's case, this power cannot be exercised for irrelevant, irrational, discriminatory or maladies considerations. The court cannot sit as a court of appeal over the order of the President/ governor granting pardon. The scope of judicial review of such a order is extremely limited, and can be exercised only in rare cases when the court finds that such an order was malafide, arbitrary or discriminatory. So therefore, it's the court to decide whether the order is arbitrary or not. I hope that answers your question.
