Page-7:'Medical boards proposed to hear abortion pleas' [GSM- 2, 3 & 4- Ethics] Issue: Medical Termination of Pregnancy Act, 1971 bars abortion of foetus post 20 weeks period but in certain cases, foetus develops abnormalities post 20-weeks period. Due to non-availability of any institutional mechanism,Women intending to abort the foetus have no option except to proceed through regular Courts, which is time consuming and it further aggravates the problem with the passage of time. Probable Solution: Permanent Medical Boards A Suggestion by Supreme Court Therefore, the Centre informed the Supreme Court that it has written to States and Union Territories about the court's suggestion to appoint permanent medical boards to provide ly rape survivors, urgent access to medical care and to consider their requests for abortion. Therefore, after writing to States & U.Ts, the Centre now stands in compliance with the court's suggestion, during the recent hearing of a separate case of a 10-year-old pregnant rape survivor, to set up permanent medical boards. Article 245 of Constitution State List: Entry 6: Public health and sanitation; hospitals and dispensaries
Question. In the light of increasing instances of foetus abnormalities being witnessed by pregnant women, consider the case for amending the Medical lermination of Pregnancy act, 1971 removing the cap of 20 weeks. Also identify the related policy dilemmas involved. Answer. Arguments in Favour: Her Body, her life-Article 21- also includes right to self determination but then what about Foetus' life- S.C. has held that foetus has a Right to Life - Also, the State also has an interest in her body- because she being a citizen of India, the State is duty bound to protect her body and hence the MTP Act 1971. Arguments against: It might lead to an increase in sex selective abortions!

Exception 2 still retains the age of consent for Sexual intercourse as 15 years, due to which there is a huge gap of three years in the age of consent for a married girl child and an unmarried girl As a matter of Fact: There are 23 million child brides in India, and there have hardly been over six convictions under the anti-child marriage law. -NGO also cited the Fourth National Family Health Survey of 2015-16,and said there were 26.8% of brides in the country who were married below the age of 18. S.Cs discomfiture: The Supreme Court said it was unfortunate that parents drive their minor children into marriage. It is a hard reality and is unfortunate that most of the child marriages happening in the country are done by parents of the girl child. When exceptio exceptions when a minor boy and girl fall in love and marry on their own n becomes the excuse to escape the law: However, to this, there are odd
