91st Amendment 2003

A) Pursuant to 164 (1) (A), if any member of the State Legislature is disqualified as a member under the Anti-Defection Act, he is also disqualified from becoming a Minister.

B) As per 164 (1) (B), the number of Ministers in the Cabinet of Ministers including the Chief Minister shall not exceed 15% of the total members of the Legislative Assembly but the total number of Ministers in the State including the Chief Minister shall not be less than 12.
