THE FACTORIES ACT, 1948: LATEST AAMENDMENT, 1987

• Scope; Factory - 10 workers or more where power is used and 20 workers or more where power is not used. Applies to the whole of India except - J and K. Even contract workers are included under - 1976 amendment.

• Health, Safety and Welfare; Min. 500 Cu.ft of space for each worker (for factories started before 1948, 350 Cu.ft). Safety officers - in factories employing > 1000 workers Welfare officer in > 500 workers and Canteen in > 250 workers.

• Act prohibits employment of children below 14 years of age and between the ages 15 to 18 – considered adolescents.

• Hours of work;48 working hours/week@ 9 hours/day (1976 amendment- 60 hours@ 10V2 hours per day)

• Leave with wages; After 12 months of continuous service @ 1 day for every 20 days of continuous work- adults and 1 day for every 15 days of continuous work. Leave can be accumulated upto - 30 days for adults and 40 days for children.

• Notifiable Occupational Disease; 1976 amendment - Byssinosis, Asbestosis, occupational dermatitis and noise induced hearing loss. All fatalities needs enquiry.

ESI option is excluded because it applies to the whole of India (north eastern states of Arunachal Pradesh, Manipur, Sikkim and Mizoram do not have any ESI facilities). Covers all power using factories employing > 10 persons and non power using, employing > 20 persons.

The Workmen's Compensation Act, 1923 was made to offer compensation to the workers who have encountered injuries due to an accident during their employment. Hence this option also excluded.

The Pradhan Mantri Jan Arogya Yojana (PM-JAY) which provides health insurance cover of Rs. 5 lakhs per year to over 10 crore poor and vulnerable families for seeking secondary and tertiary care. Hence this option is excluded.
