Unacademy NEET Assure – Terms & Conditions

1. The Unacademy NEET Assure (“Program”) is a program organized by M/s Sorting Hat Technologies Private Limited (“Unacademy”) which offers access to 12 months free Plus Subscription for NEET (“Offer”) for Learners who received less than 580 marks (“NEET Assure Qualifying Mark”) in the NEET exam (“Exam”) subject to Unacademy’s NEET Assure Terms and Conditions (“Program Terms”) herein.
2. The Program shall be governed by these Program Terms as well as all other polices and terms and conditions (hereinafter collectively referred to as “Platform Terms”) available on www.unacademy.com . The Participants (defined below) and Unacademy shall be collectively referred to as Parties and individually as Party.
3. All capitalized terms not defined in the Program Terms shall have the meaning assigned to it under the Platform Terms and in the event of conflict, the Program Terms shall prevail unless specified otherwise.
4. To be eligible for the Offer, individuals shall be required to purchase the subscriptions to more than or equal to 1 year NEET Iconic or NEET Iconic Combo (“Course(s)”) during the offer period as may be communicated by Unacademy from time to time (“Offer Period”).
5. The Program is applicable to all individuals who (i) is an Indian citizen (ii) resides in India (ii) who purchase a Course during the Offer Period (iv) legally eligible to enter into a contract or fulfils the Age Requirements.
6. To avail the Offer, the Learners who purchase 1 year subscriptions to the Course within the Offer Period shall write the Exam in 2024 (“Assure Learners 2024”) and the Learners who purchase subscriptions exceeding one year to the Course within the Offer Period shall write the Exam in 2025 (“Assure Learners 2025”).
7. Assure Learners 2024 shall be eligible to avail the Offer in 2024 only and Assure Learners 2025 shall be eligible to avail the Offer in 2025 only.
8. Once the results of the Exam are declared, the Learners who have scored less than the NEET Assure Qualifying Mark may contact the Unacademy learner support through the options enabled on the help and support page of the Platform within 15 days to avail the Offer.
9. Such Learner shall be required to submit fill a form or submit documents or details as may be requested by Unacademy within the timeline prescribed by Unacademy. Subject to verification by Unacademy, Learners who satisfy the eligibility criteria prescribed here shall be eligible to receive free access to 12 months Plus Subscription to NEET course. Unacademy shall send a confirmation to successful Learners with details related to accessing the free NEET Plus Subscription.
10. Unacademy shall be well within its rights to reject/ the Participant from the Program or Offer if: (a) the documents or details provided by the Participant are invalid/incorrect/incomplete/ misleading /untrue or not acceptable in the opinion of Unacademy; (b) the Participant has not conformed to any of the terms and conditions contained herein; (c) the Participant does not sign the consent form or any other documents required, if any, by Unacademy concerning the Program; (d) the Participant has engaged in any fraudulent activity as may be determined by Unacademy; (e) any other reason as may be deemed appropriate by Unacademy. The Participant shall be barred from participating in any future programs at the sole discretion of Unacademy.
11. Unacademy does not accept any responsibility for any incorrect and/or incomplete communication details provided and/or delay in receipt of communication and/or non-receipt of communication.
12. The decision of Unacademy on all matters pertaining to the Program and processing Cashback shall be final and binding on all parties.
13. Unacademy shall have the sole discretion to discontinue / cancel/modify the Program Terms or any part thereof at any point in time and the Participant shall not raise any claim due to such discontinuation or cancellation or modification at any time whatsoever.
14. Unacademy shall not be liable for any loss, claim, damage, expenses whether expressed, implied, real, or consequential incurred by the Participant due to participation, non-participation or otherwise in the Program.
15. Unacademy shall not be responsible for paying any applicable taxes, fee, charges, etc. related to the Offer.
16. Any disputes with respect to Offer shall subject to be governed by and construed in accordance with the laws of India, without reference to principles of conflict of laws and the courts in Bangalore shall have the exclusive jurisdiction to determine any disputes arising out of, under, or in relation to, the Program.
17. Participation in the Program is voluntary and Unacademy does not charge any registration fee for the same. The Program is being made available purely on a best effort basis.
18. The Learner shall indemnify Unacademy against any claims from any party and consequent losses, damages, or compensation, whatsoever, that may arise from any use, including but not limited to, the publication of response (s) submitted by the Learner as a part of, or in association with the Program.
19. Unacademy shall not be liable for any failure to comply with its obligations caused by weather conditions, fire, flood, strike, hurricane, industrial dispute, war, hostilities, terrorist attack, political unrest, riots, civil commotion, inevitable accidents, acts of God or any other circumstances amounting to Force Majeure.
20. Unacademy shall not be responsible for any loss or damage if it has to discontinue or cancel this Program in compliance with any law, ruling, order, regulation, requirement or instruction of any Central/State Government or for any other unavoidable reason beyond its control. The Participant/s shall be informed of such discontinuance/cancellation as soon as possible.
21. The aggregate liability of Unacademy in case of any damage, loss, cost, claim, liability or expense (including legal costs and expenses) caused to or incurred by any act, omission or representation arising out of this Program, shall not exceed Rs. 50.
22. Unacademy shall not be responsible for any errors or omissions in the terms and conditions contained herein. All information provided is provided “as is” without warranty of any kind. To the fullest extent permitted by applicable law, Unacademy disclaims all warranties, express or implied, including without limitation, implied warranties of merchantability, fitness for a particular purpose, and non-infringement in respect of the Program.
23. Unacademy shall have the sole discretion to discontinue / cancel the Program or any part thereof at any point in time and the Participant shall not raise any claim due to such discontinuation or cancellation at any time whatsoever.
